Dickinson College President John Jones, a former federal judge in Pennsylvania, said that Cullen’s decision to invoke the wider political climate was relevant to the case. Judges are supposed to “exercise appropriate restraint and not make gratuitous statements,” Jones said, but Cullen had valid reasons to draw a line from US officials’ public vitriol about members of the judiciary to the administration’s decision to sue an entire court.
“The footnote was an extension of his incredulity that somebody would file a lawsuit like this,” said Jones, who was nominated to the bench by former President George W. Bush and is part of the Article III Coalition, a bipartisan group of retired judges speaking out in defense of active judges facing attacks and threats.
